READ THIS FIRST — THIS IS NOT THE PURCHASE CONTRACT: These Terms explain our business practices, website rules, and client communication standards. Real estate purchases and sales require a formal written contract signed by all parties (typically a Florida Realtors / The Florida Bar "AS IS" Contract) and closing through a licensed Florida title company. Always have a Florida real estate attorney review legal documents before signing.

1. Who We Are

Tim Sherman, PA is a licensed Florida Real Estate Sales Associate (License #SL3480036) affiliated with Momentum Realty. Tim operates as "The Saltwater Realtor," providing specialized waterfront, marina, and coastal residential representation throughout Duval, Nassau, and St. Johns Counties.

Brokerage Standards: Brokerage services are rendered under Florida Statute § 475.278 as a Transaction Broker unless another authorized brokerage relationship is executed in writing.

3.1 Informational only

Content on this website (market updates, net sheet tools, guidebooks, and tax calculators) is provided for general informational purposes for Florida homeowners and buyers. It does not constitute legal, tax, accounting, or formal appraisal advice. Consult a Florida attorney, CPA, or licensed mortgage lender regarding your specific scenario.

3.2 Accuracy and market fluctuations

While we strive for precision, market statistics, mortgage interest rates, tax millage figures, and HOA/CDD fees are subject to periodic change. Users must verify property-specific figures through county property appraisers, tax collectors, lenders, and closing agents.

3.3 Intellectual property & acceptable use

All logos, custom calculators, design styles, photography, and written copy belong to Tim Sherman PA d/b/a The Saltwater Realtor or its licensors. You may print copies of these Terms for your personal records. You may not scrape, frame, clone, or duplicate site content for commercial real estate competition.

4. Marine, Waterfront & Coastal Property Disclosures

4.1 Navigational Depths & Mean Low Water (MLW)

Water depths along the Intracoastal Waterway (ICW), tidal creeks, and marina basins vary significantly with tides, siltation, dredging schedules, and lunar cycles. Depth figures, bridge clearances, and boat slip dimensions on this website are approximate reference figures. Buyers are advised to take physical soundings at Mean Low Water (MLW) and consult marine charts before purchasing a vessel or dock.

4.2 Dock Permitting & Riparian Rights

Construction, expansion, or dredging of private docks, boat lifts, and seawalls requires permits from the Florida Department of Environmental Protection (FDEP), St. Johns River Water Management District (SJRWMD), U.S. Army Corps of Engineers (USACE), and local municipal authorities. Tim Sherman does not guarantee dock permit transferability or lift weight capacities.

4.3 Coastal Flood Zones & Windstorm Insurance

Coastal and barrier island properties are frequently situated in FEMA VE or AE high-risk flood hazard zones. Buyers must independently verify base flood elevations, elevation certificates, and windstorm/flood insurance premiums with a licensed Florida insurance agent.

5. Written Buyer Agreement Requirement Before Tours

Under 2024 NAR rules, every prospective buyer must sign a written buyer representation agreement before touring coastal homes or boat slips with Tim Sherman. This agreement details compensation, representation duties, and showing arrangements.

8. Communications Consent & SMS Terms and Conditions

By providing a telephone number or email address through an online form or inquiry, you consent to receive informational and transactional communications from Tim Sherman PA d/b/a The Saltwater Realtor via phone calls, SMS/text messages, and email regarding your property questions, showing schedules, or real estate services.

TERMS AND CONDITIONS

  1. We use SMS to confirm appointments, send reminders, and notify clients of schedule updates or important changes.
  2. You can cancel the SMS service at any time. Just text "STOP". After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.
  3. If you are experiencing issues with the messaging program you can reply with the keyword "HELP" for more assistance, or you can get help directly at agenttimsherman@gmail.com.
  4. Carriers are not liable for delayed or undelivered messages.
  5. As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency may vary. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

9. Fair Housing Commitment

The Saltwater Realtor strictly adheres to Title VIII of the Civil Rights Act of 1968 (Fair Housing Act) and the Florida Fair Housing Act. We provide equal professional service to all individuals without regard to race, color, religion, sex, handicap, familial status, national origin, sexual orientation, or gender identity.

10. Limitation of Liability & Governing Law

To the maximum extent permitted by Florida law, this website and pre-representation materials are provided "as is" without warranty. Tim Sherman PA d/b/a The Saltwater Realtor is not liable for market changes, third-party mortgage underwriting denials, or decisions made based on general web estimates. Claims arising from website use are governed exclusively by the laws of the State of Florida, with venue in the appropriate Florida County court.
